Staitmint Terms of Service

Effective date: October 5, 2026

These terms are an agreement between you and Optaimum LLC ("we", "us"), 1100 S Miami Ave, Apt 3302, Miami, FL 33130, for your use of the Staitmint app and service ("Staitmint"). By creating an account or using Staitmint, you agree to these terms and to our Privacy Policy. If you don't agree, don't use Staitmint.

1. Who can use Staitmint

You must be at least 18 years old to use Staitmint. If you're a parent or guardian and believe someone under 18 is using Staitmint, contact us at jack@optaimum.com and we'll delete their account. Your use of Staitmint must be legal where you live.

2. Your account

You're responsible for your account and everything done with it. Keep your sign-in details secure, give us accurate information, and tell us at jack@optaimum.com if you think your account has been compromised. An account is for one person.

3. What Staitmint does

Staitmint is an AI assistant for style, fitness, travel and everyday planning. It can remember facts about you to personalise replies, connect to Google Calendar and Spotify if you choose, find nearby places and search travel options. Features may change, be added or be removed over time.

4. AI responses: please read

Staitmint's replies are generated by artificial intelligence (models from OpenAI and Google), not by people.

• Responses may be inaccurate, incomplete, out of date or inappropriate, even when they sound confident. Check anything important before relying on it.
• Staitmint is not professional advice. Nothing it says is medical, health, fitness, nutrition, mental-health, legal, financial or other professional advice. Talk to a qualified professional before making decisions in those areas, especially before starting a new exercise or diet programme.
• In an emergency, contact your local emergency services. Staitmint can't help in an emergency.
• Travel and place information comes from third parties and may be wrong or change without notice. Prices and availability aren't guaranteed. Any booking you make is with the third party, on their terms, not with us.
• Facts the assistant infers about you can be wrong. You can review, correct and delete them under Facts.

You are responsible for how you use Staitmint's responses.

5. Your content

"Your content" means the messages, photos and other material you give Staitmint. You keep ownership of it. You give us a worldwide, non-exclusive, royalty-free licence to host, store, process and transmit your content only as needed to provide Staitmint to you. That includes sending it to our AI providers and other service providers as described in the Privacy Policy. This licence ends when your content is deleted, except for copies our service providers keep under their own retention (described in the Privacy Policy).

You're responsible for your content. Only upload photos you have the right to share, and don't upload photos of other people without their permission.

6. Acceptable use

Don't use Staitmint to:

• break the law or infringe anyone's rights;
• harass, threaten or harm anyone, or create sexual content involving minors;
• upload malware, or try to access accounts, data or systems you aren't authorised to access;
• interfere with or overload the service, or get around its limits (including the free-reply limit);
• scrape, copy or resell the service, or use it to build a competing product;
• generate content that violates our AI providers' usage policies.

We may suspend or end access for anyone who breaks these rules.

7. Free use and subscriptions

Free use. Without a subscription, Staitmint includes a limited number of free replies. We may change what the free tier includes.

Staitmint Premium is an auto-renewable subscription sold through Apple's App Store. The plans, their length and their price are shown in the app before you buy.

• Payment is charged to your Apple ID account when you confirm the purchase.
• Your subscription renews automatically at the same price and for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
• Free trials. If a plan offers a free trial and you're eligible, you won't be charged during the trial. The subscription converts to paid at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited when you buy a subscription.
• Manage or cancel in your iPhone's Settings → [your name] → Subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the period you've paid for.
• Deleting your Staitmint account does not cancel your subscription. Cancel it in Settings as well.
• Refunds are handled by Apple under Apple's policies. We can't issue App Store refunds ourselves.
• Price changes follow Apple's rules: Apple will notify you and, where required, ask for your consent before a higher price applies.

8. Connected services and third parties

Staitmint works with services we don't control, including Apple, Google (Sign-In, Calendar, Places), Spotify, and travel data providers. Your use of those services is governed by their own terms and privacy policies. We aren't responsible for them, and a connected feature may stop working if a third party changes or withdraws its service.

9. Ending your use

You can stop using Staitmint at any time and delete your account in the app (Accounts → Delete account). This permanently deletes your data as described in the Privacy Policy. We may suspend or end your access if you breach these terms, if required by law, or if we discontinue Staitmint. If we discontinue it, we'll give reasonable notice where we can. Sections 4, 5 (for content not yet deleted), and 10–13 survive termination.

10. Disclaimers

Staitmint is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Staitmint will be uninterrupted, error-free or secure, or that its responses will be accurate. Some places don't allow these disclaimers, so some may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of Staitmint or its responses. Our total liability for any claim relating to Staitmint is limited to the greater of the amount you paid us for Staitmint in the 12 months before the claim, or US$50. Nothing in these terms limits liability that can't be limited by law.

12. Indemnity

To the extent permitted by law, you agree to indemnify us against third-party claims arising from your content or your breach of these terms.

13. Governing law and disputes

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you and we consent to their jurisdiction. If you're a consumer outside the US, you also keep any protections given to you by the mandatory laws of the country where you live.

14. Apple App Store terms

If you downloaded Staitmint from Apple's App Store, these additional terms apply:

1. Parties. These terms are between you and us, not Apple. We, not Apple, are solely responsible for Staitmint and its content.
2. Licence. We grant you a non-transferable licence to use Staitmint on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
3. Maintenance and support. We are solely responsible for maintenance and support. Apple has no obligation to provide any.
4. Warranty. To the extent any warranty applies and isn't effectively disclaimed, we, not Apple, are responsible for it. If Staitmint fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the app to you. Apple has no other warranty obligation for Staitmint.
5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Staitmint, including product liability claims, claims that it fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
6. Intellectual property. If a third party claims that Staitmint or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging the claim.
7. Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms. You must comply with applicable third-party terms (for example, your mobile data agreement) when using Staitmint.
10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

15. Changes to these terms

We may update these terms. If a change is material, we'll tell you in the app before it takes effect. If you keep using Staitmint after it takes effect, you accept the updated terms. If you don't agree, stop using Staitmint and delete your account.

16. General

If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a right, we haven't waived it. You can't transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between you and us about Staitmint.
